<div>Evidently some dealers and manufacturers have been telling consumers of leased vehicles that they do not have the same &#8220;lemon law&#8221; rights when they lease cars. This is not accurate. The fact of a lease does have some impact upon a consumer&#8217;s lemon law rights, but the consumer yet retains substantially the same lemon law rights as purchasers of vehicles. Here are the points you need to know:</p>
<p>1. In a lease, you really do not have any equity in the car so your damages are usually limited to your inception payment and your payments into the vehicle. If the manufacturer or dealer agrees to unwind the lease, you need to make sure that the lease is being paid off in the settlement so this does not remain an obligation which ultimately could affect your credit.</p>
<p>2. Many manufacturers argue for a larger &#8220;mileage offset&#8221; for leases, because, they claim, the mileage on the vehicle is a greater percentage of the more limited period of the lease as opposed to the longer period of &#8220;permanent ownership&#8221; in the event of a sale. This is a negotiation point to be worked out on a case-by-case basis, depending upon the total circumstance.</p>
<p>3. In general, if you wait until late into the lease to bring your lemon law claim, the manufacturers will more than likely ignore you on the basis that your lease is substantially used up. So, for instance, if you have a three-year lease and you bring your lemon law claim after 18 months, you stand a far greater chance of getting a good result than if you wait until 28 months into the lease. The longer you wait, the more likely the manufacturer will just sit back and say, &#8220;The lease is almost up-let&#8217;s ignore this lemon law claim.&#8221;</p>
<p>4. Many leases include a &#8220;residual value&#8221; (agreed-upon value upon lease expiration, most frequently used to calculate the cost of purchasing the vehicle) as a part of the lease. If the residual value is less than the total lease payoff, some manufacturers try to &#8220;sucker&#8221; consumers into believing that the manufacturer is only responsible for paying the residual value, not the lease pay-off, when the case settles. Ignore this crap. If you win your lemon law claim, you have a right to have your lease completely paid off. Settlements may vary and, depending on the circumstances, may or may not accomplish complete payoff of the lease, but this is no reason to buy into this poor argument from manufacturers that the residual value has anything to do with settling the case.</p>
<p>5. If you exceed your mileage allotment significantly, this will negatively affect the strength of your lemon law claim. As with all lemon law cases, if you can afford to limit your driving of the vehicle, or even park it, this will improve chances of winning and of getting full compensation.</p>
<p>6. Whether you buy the car at lease expiration is up to you, and you can continue with your lemon law claim on a leased vehicle even if the lease is expired and you have had to turn in your car. However, since you no longer have the car, the case is obviously worth less total money and it usually makes more sense to settle for some cash compensation once the vehicle&#8217;s lease has expired.</p>
<p>7. If you have a lease fraud or a finance fraud claim, this normally is not treated as a lemon law claim and involves a whole different set of rights about which you should consult us directly.</p>

<div>Technology, particularly home entertainment technology, should be simple to use.  This simplicity of use is especially important for home entertainment technology because it ensures that the device that embodies that technology can be enjoyed rather than futzed with in order to make it work.  Far too often technology is complicated by economic factors rather than just technical factors, and is therefore far too difficult to use in many respects.  For example, it&#8217;s completely conceivable that some new home entertainment gizmo could be so expensive that consumers never get around to buying it, or worse never get around to using it because they&#8217;re too busy working extra jobs to pay for it.</p>
<p>HDTV DVD technology is a good example of a type of home entertainment technology that has problems.  It has been expensive, but it&#8217;s not so expensive that normal people can&#8217;t afford it.  (It has also been coming down in price in recent months.)  High Def DVD technology is also very easy to use, so that&#8217;s not a barrier to purchasing it and enjoying it. What does present a problem for consumers when it comes to high def DVD technology is the fact that it comes in two incompatible formats that are in a format war right now.</p>
<p>This situation is unfortunate for consumers on a number of different levels.  First of all, the two formats- HD DVD from Toshiba and Blu-ray from Sony- are both good technologies, and either one would provide plenty of enjoyment for anyone who buys the format.  The trouble comes from the fact that no one is sure which format will still be available after the war is over.  Therefore no one is sure which type of format to invest in right now, because while High Def DVD technology is affordable, it&#8217;s not so cheap that most people can buy one of each type of player. Even if most families could afford more than one high def DVD player, there is also the desire to choose the winning format.  By extension, this creates an aversion to choosing the losing format, so since people don&#8217;t know which one will win, they&#8217;re choosing not to choose either of the two.  Again, this is a shame because high def DVD technology in general is good, user friendly technology.</p>
<p>There are some noticeable differences between the two formats though that could influence the outcome of the war.  While both formats are capable of storing an entire full length movie plus its bonus features on a single disc, there is a big difference in capacity between the two.  HD DVD discs can store fifteen gigabytes on each side of the disc, so that if both sides are used, the total storage capacity is an impressive thirty gigabytes.  The Blu-ray format does even better.  Each side of a Blu-ray disc can store twenty five gigabytes for a total capacity of fifty gigabytes.  With a difference in capacity of twenty gigabytes, Blu-ray obviously has superior data storage features.  That having been said, HD DVD generally has superior interactive features, but it remains to be seen how important the ability to rearrange the scenes in a movie or order parts of the wardrobe online really are to most people who just want to watch a movie.</p>
<p>In all, the sooner the format war is over, the better for consumers.</p>

<div><strong>Introduction</strong></p>
<p>Comparative advertising takes place when one trader’s business is compared to another trader’s business with reference to their trade mark or trade name. The advertisement usually presents comparisons of price and particular qualities of goods, intended to inform consumers that the second trader’s goods or services are somehow superior. The comparisons are most frequently made to the products or services of a leader in the market.</p>
<p>There are various ways in which a trader can undertake comparative advertising, including:</p>
<p>referring to a competitor by name;</p>
<p>referring to a competitor’s trade mark;</p>
<p>not referring specifically to the competitor by name, but referring to ‘the leading brand’ where consumers will know what that leading brand is; or</p>
<p>stating which products are compatible with those of a competitor and issuing a table listing the serial numbers of each party.</p>
<p>For years there have been a number of questions raised in relation to the legality of comparative advertising and whether it should be permitted. Fair and honest Advertisements did not cause any harm were therefore lawful. This position stemmed from the introduction of Comparative Advertising Directive (EEC) (Council Directive 97/55 amending The Misleading and Comparative Advertising Directive (Council Directive 84/450) (the ‘Directive’) provides guidance as to the boundaries of comparative advertising and provide strict criteria that an advert must meet in order to be lawful.</p>
<p><strong>Comparative advertising and </strong><strong>the Directive on Comparative Advertising</strong></p>
<p>Comparative advertising is defined by Article 2 of Directive 84/450 as:</p>
<p>“… any advertising which explicitly or by implication identifies a competitor or goods or services offered by a competitor.”</p>
<p>Furthermore, Article 3 provides a list of criteria where comparative advertising will be allowed:</p>
<p>“ …</p>
<p>(1) it is not misleading … ;</p>
<p>(2) it compares goods or services meeting the same needs or intended for the same purpose;</p>
<p>(3) it objectively compares one or more material, relevant, verifiable and representative features of those goods and services, which may include price;</p>
<p>(4) it does not create confusion in the market place between the advertiser’s trade marks, trade names, other distinguishing marks, goods or services and those of a competitor;</p>
<p>(5) it does not discredit or denigrate the trade marks, trade names, other distinguishing marks, goods, services activities or circumstances of a competitor;</p>
<p>(6) for products with designation of origin, it relates in each case to products with the same designation;</p>
<p>(7) it does not take unfair advantage of the reputation of a trade mark, trade name or other distinguishing marks of a competitor or of the designation of origin of competing products;</p>
<p>(8) it does not present goods or services as imitations or replicas of goods or services bearing a protected trade mark or trade names.”</p>
<p>This list of permitted use is, in comparison, more prescriptive than the provisions laid down in the TMA which simply requires comparative advertising to be in accordance with “honest practices”.</p>
<p>The European Court of Justice (‘ECJ’) considered the issue of comparative advertising in the case of Pippig Augenoptik GmbH &#038; Co KG v Hartlauer Handelsgesellschaft mbH [2003] ECR I-3095. The ECJ considered the impact of comparative advertising and the purpose it served, stating that it was important in assisting consumers in making informed choices. Following the approach taken in Toshiba v Katun [2003] ETMR 296, the court concluded that “ … the conditions required of comparative advertising must be interpreted in the sense most favourable to it.”</p>
<p><strong>Comparative advertising and the Trade Marks Act 1994</strong></p>
<p>Section 10(6) of the TMA states:</p>
<p>“Nothing in the preceding provisions of this section shall be construed as preventing the used of a registered trade mark by any person for the purpose of identifying goods or services as those of the proprietor or licensee.</p>
<p>But any such use otherwise than in accordance with honest practices in industrial or commercial matters shall be treated as infringing the registered trade mark if the use without due cause takes unfair advantage of, or is detrimental to, the distinctive character or repute of the trade mark.”</p>
<p>Protection against comparative advertising is provided as long as the registered trade mark is used in relation to the genuine goods or services of the proprietor and that such use accords with honest practice, that is to say is fair and accurate. Where this is not the case, any comparative advertising will be treated as an infringement if it is use which takes advantage of or is detrimental to the distinctive nature or reputation of the registered trade mark.</p>
<p>So how is ‘honesty’ to be judged? The test is an objective one and it is for the trade mark owner to establish on the facts that the advertisement making the comparison was considered dishonest by “members of a reasonable audience” (Barclays Bank plc v RBS Advanta [1996] RPC 307).</p>
<p>In the case of Emaco Ltd and Aktienbolaget Electrolux v Dyson Appliances Ltd [1999] ETMR 903, both manufacturers of vacuum cleaners engaged in advertising campaigns which stated that having undergone independent tests, each product was superior to the other. They then proceeded to sue each other for malicious falsehood and trade mark infringement. The Court dismissed the claims for malicious falsehood but upheld the claims for trade mark infringement upon the basis that the tests conducted were unfair in that they were not done under normal circumstances and both parties had been involved in unfair comparative advertising.</p>
<p>This can be contrasted with the case of British Airways plc v Ryanair Ltd [2001] ETMR 235 where British Airways claimed that Ryanair’s advertisements comparing their prices was misleading as it had stated they were 5 times more expensive. However, the Court dismissed the action stating that even if Ryanair’s advertisement was misleading, it was not materially misleading given that the point they were trying to make, namely that flying with British Airways was a lot more expensive than flying with Ryanair, was still the same. This decision illustrates the permissive approach of the UK courts in dealing with comparative advertising. Although the approach has been criticised, it is in keeping with pro-competition stance the Court has adopted it has had for so many years.</p>
<p>Directive 97/55 has been incorporated into UK law by The Control of Misleading Advertisements (Amendment) Regulations 2000 which inserts a new regulation into the 1998 Regulations. On the face of it, the Directive may appear more restrictive, but the High Court in British Airways plc v Ryanair Ltd held that the Directive does not affect the interpretation of the TMA. However, it is fair to say that the TMA and the Directive are to be read in conjunction with one another and while adhering to “honest practice” under the TMA, an advertisement must also comply with the Directive.</p>
<p><strong>Conclusion</strong></p>
<p>The use of competitors’ trade marks no longer represents a “no-go zone” for businesses competing in the same industry. Provided that the criterion set out in the legislation is adhered to, businesses are able to use other company’s trade marks and trade names to identity the relative merits of their own products and services over those of their competitors.</p>

<div>Why buy &#8216;new&#8217; computer equipment when you can get the same refurbished computer at up to 80% savings and there is no difference in the quality or warranty? Statistics show that people who have already bought a factory refurbished computer will never buy &#8216;new&#8217; computer again! Manufacturers are so sure about their refurbished computer equipment that they offer the original warranties.</p>
<p>Exactly what is considered factory refurbished computer equipment?</p>
<p>A lot of things can be labeled factory refurbished. So frivolous are some that it&#8217;s silly enough to make you laugh! Consumer laws prevent manufacturers from selling anything considered factory refurbished as new, so the second consumer gets the best deal and it’s just like a new computer!</p>
<p>For example, most major retail stores offer a 30 day money back guarantee on their computer equipment and some consumers take advantage of this. So when the new computer is returned, the manufacturer inspects the product and repackages it like new. But it can&#8217;t be sold as new now so you get a great price with the original warranty, now it’s considered a refurbished computer. Other reasons may be the box was damaged in shipment and so it was returned, a slight defect, the defective part is replaced by the manufacturer, tested and then repackaged just like new. Maybe a minor cosmetic blemish on the casing that was corrected. Demonstration units are also considered factory refurbished computers. They are also inspected, tested and repackaged. The box was simply opened or brand new items that have been overstocked are also labeled factory refurbished.</p>
<p>It’s hard to tell the history of each and every refurbished computer item but whatever the reason for the refurbished label you can be sure that the computer equipment has been inspected and serviced by the manufacturer then tested and repackaged to meet original product specifications, just like a new computer. And like I said before, all computer equipment merchandise is warranted by the original manufacturer unless otherwise specified.</p>
<p>Why buy a refurbished computer?</p>
<p>Well, to save MONEY! Why not get the best value while getting the exact same computer equipment? Also, you get the original manufacturer’s warranty and get a much, much lower price on your new computer.</p>
<p>Now with refurbished computer equipment you can afford that item which has been just out of your reach because it cost too much. And you will get the same performance! Actually refurbished items have a much lower defect rate than new ones. Only one in ten units that come back for repair is usually a factory refurb! That is because they are closely tested before they are sold. The only difference you may notice is a little label on the outside of the box or simply a brown box. So think hard before your purchase, are you shopping smart?</p>

<div>The Florida lemon law cover new and demonstrator vehicles and if they are leased, they are also covered. There is a list of vehicles that are not covered and they include trucks carrying more than 10,000 pounds, recreation vehicles, motorcycles and mopeds, vehicles purchased for resale and off road vehicles. If you are not familiar with the lemon laws, they are laws specially designed to protect those consumers who buy defective cars from car dealers and manufacturers. And in Florida, the laws are very active and they seek to deliver justice to every person who has been unfairly affected.</p>
<p>Therefore, if you find that your car is a lemon, you can follow the steps provided and you will achieve your desired goal. The first thing is to take your car to the repair shop and keep a record of every visit. You will eventually find that if it is indeed a lemon, there is no cure for it. Florida lemon law provides that you take the car at least 3 times. You are advised not to waste any time and the next thing you do is to notify the manufacturer through certified, registered or even express mail. The next step is to seek a solution through the arbitration programs and in the manufacturers&#8217; one, the two parties come together with a third party who will act as a mediator and take them through the dispute.</p>
<p>In Florida, these arbitration programs are very vital and are necessary before they can move to the next stage. The next is a state arbitration program where the New Florida Arbitration Board seats to come up with a solution to the case and if the lemon owner wins the case, they are given a refund or replacement and also, the other incurred costs are catered for. The consumer may be told to choose between a refund or replacement. Florida does not have a used car lemon law but, people with a problem can follow the same procedures and they can be helped without the need to quote from the Florida lemon law.</p>

Therefore, if you live in Florida, you do not have to worry because of a lemon case because there is a solution thanks to the state lemon laws.</p>

<div>When a car is sold to you that is not in the same condition it was advertised to be in or breaks down soon after you buy it due to a long-term problem that existed before you purchased the car, it is considered to be a lemon. Buying a car that is a lemon is unacceptable. You should not have to put up with the consequences involved with the purchase of a lemon car, such as paying for repairs or replacing it. This applies to both a new car or a used car.</p>
<p>What Is The Lemon Law?</p>
<p>The lemon law was introduced to protect everyday people from having to deal with a car that is considered a &#8220;lemon&#8221; or is faulty, through no fault of the new owner. The lemon law was designed to protect consumers and keep the car sales people honest, whether the sale is private or commercial. As a buyer, if you are told that a car is in good working order and soon after buying it, the vehicle breaks down, there is a big chance that the car was faulty before you bought it, as well as a good chance that the previous owner was already aware that the problem existed.</p>
<p>Every state has different rules and regulations with regard to the lemon law, but they have been set in place for the same reason and that is to protect the consumer from being taken advantage of by a dishonest seller.</p>
<p>Suspect Your Car Is A Lemon? Know Your Rights.</p>
<p>Before purchasing a car, either new or used, it is a good idea to research what your rights are with the lemon law and request a vehicle inspection from an outside company to make sure that the car is in good working order. These steps can help avoid a lemon law dispute after the purchase of a vehicle.</p>
<p>If you have just purchased a new or used car and suspect it is a lemon, you should first ask the private seller or car dealership where you purchased the vehicle to make the repairs, or cover the costs. Even in states with tough lemon laws, you will be required to attempt to resolve the problem with the seller first, which only makes good logical sense.</p>
<p>If they are not willing to repair a vehicle, even though, when they sold it to you, they gave you their word or a written document that the car was in good working order, you have rights under the lemon laws, so use them. There are two ways to exercise your lemon law rights &#8211; you can represent yourself or seek professional advice and representation from a lemon law attorney.</p>
<p>If you represent yourself, you must do a great deal of research and educate yourself on how the lemon laws work in your state. Representing yourself can be risky because you don&#8217;t have the proper working knowledge of the legal system or may make mistakes that go in the favor of the seller.</p>
<p>A lemon law attorney specializes in the legalities of the lemon law in your state and how best to represent you and your dispute in a positive manner. You will also be given an insight on how the lemon laws work in your state and the legal process, all explained in simple, easy to understand terms. If you have a car that fits this description, a lemon law attorney is likely to be well worth the investment.</p>
